Futrix^® Demonstration Trial License

Ownership

Futrix and all associated or accompanying documentation, copyrights, trademarks, designs, images, business information and all other intellectual property are owned by Futrix Limited, New Zealand ("the owner") and are distributed worldwide by distributors or value added resellers appointed and licensed by the owner.

Use with SAS^® System Software

Futrix is a front end to SAS Institute's decision making software and should be used only in conjunction with the SAS System software. Use with any other software is prohibited under this license.

License

This software license applies to the free, demonstration (evaluation) version of Futrix. (If you have purchased a license for the full version of Futrix, that license supersedes this license and shall be observed by all parties who have signed it.)

This license is binding, and you should read it carefully before using the software for the first time. The two options available to you upon reading this license are either to accept its terms and conditions or to reject them. Clicking on the "I Agree" button below this window means that you agree to accept the terms and conditions of this license. Clicking on the "I Do Not Agree" button below this window means that you do not accept the terms and conditions of this license and you should therefore not use, download, install or copy the software.

This license grants you the right to use the software for a limited period of time. However, you may not:

(a) copy the software or any part or manifestation of it;
(b) reverse engineer the software;
(c) modify the software or any part or manifestation of it;
(d) translate the software into any other spoken or computer language;
(e) reproduce the software or any part or manifestation of it;
(f) publicly display the software or any of its associated or related documentation;
(g) transfer the software for use on any other computer or through any network; or
(h) create derivative works from the software.

Registration

Assuming that you have agreed to the terms and conditions in this License and have clicked on the "I Agree" button, you will be taken to another page in this website which will contain a questionnaire which will enable you to register to be able to use the software. You will be asked for your correct, current email address so that we can e-mail you the licensing code ("Futrix License key") which will allow you to use the demonstration version free of charge. Without this code, the software will not operate.

Should you wish to convert this license to a full license, you will need to contact the Futrix partner in your area. A list of partners and their contact details can be found in this website on the Partner Directory Page, or by clicking on the Partners link on any page in this site.

Governing Law

This license shall be governed by the laws of New Zealand.

Disclaimer of Warranty

THIS DEMONSTRATION SOFTWARE AND ANY ACCOMPANYING FILES, INCLUDING HELP FILES AND ANY OTHER SUPPORTING DOCUMENTATION, ARE LICENSED "AS IS" AND WITHOUT WARRANTIES AS TO PERFORMANCE, MERCHANTABILITY, OR FITNESS FOR A PARTICULAR PURPOSE OR ANY OTHER WARRANTIES WHETHER EXPRESS OR IMPLIED. In particular, there is no warranty that this software will run without error or at all on any given hardware platform or in conjunction with the version of the SAS System software previously installed by you. Neither Futrix's owner or any of its agents, value added resellers, dealers, consultants or any other party directly or indirectly acting on its behalf shall be responsible for any monetary, financial, physical or computer damage of any sort or any loss(es) whether direct, indirect or consequential caused by the software or its use.

Support

This license entitles you to free support relating to the installation (only) of the software. However, training is available from your nearest dealer or value added reseller on a fee-paying basis. A list of dealers or value added resellers offering support and training can be found in this website on the Partner Directory Page, or by clicking on the Partners link on any page in this site.

Distribution of Demonstration Version

You may not distribute this software by any means including rental, sale, lease, loan or pay-by-use basis to any other user. The Futrix License key which is issued to you is in your organization's name and may not be transferred to any other organization. Failure to adhere to this provision will render the software inoperative and may subject you to civil or criminal penalties under relevant and applicable law.
